Terms of Service

By sending payment and commissioning me, you acknowledge that you have understood and accepted my terms and conditions

General

  • All commissions are digital products

  • Commissions are for personal use only. For commercial use, there will be an additional fee

  • The client must contact me via the provided Google Form

  • Please be patient with me!!! My personal life and labor will affect the speed of delivery

  • Be kind! Any aggressive, rude, or inappropriate behavior against me at any time during the process will result in me cancelling the commission. I will refund you 75% of the payment

I, as the Artist

  • Maintain the rights to post commissions to my social media for advertising. However, I will not post any pieces upon request

  • Credit for character designs will be given to the respective owner

  • Maintain the right to deny or cancel any commission

  • After I begin, no refunds will be allowed unless I am unable to finish the commission

  • I will do my best to keep in contact throughout the commission. I will provide updates

You, as the Client

  • Must credit Starryair as the artist of your commissioned piece

  • May use the commission for personal use

  • May edit, crop, and resize the commissioned art. HOWEVER, you still must credit me for the piece

  • May post the work to your own website/ social media, but you should credit me for the work

  • Can NOT trace or modify my work UNLESS you have my explicit written permission. If approved, augmented pieces cannot be posted to social media

  • Can NOT use commissions for non-fungible tokens (NFTs) or AI purposes. Seriously, does anyone buy NFTs nowadays?

  • Commercial usage is not allowed, unless the respective fee is paid

  • May NOT remove my watermark without proper authorization.

Payment

  • All payments are through PayPal, in USD

  • I do NOT accept cryptocurrency or checks

  • I must be paid 50% before I start the commission, 50% when I complete the commission

  • For any sketch commissions, full price must be paid

Refunds

  • Orders can be cancelled if the work has not been started

  • You may not request a refund after the sketch has been approved of

  • If, for any reason you wish to cancel your commission after paying the initial 50% BUT before the sketch has been finalized, I will provide a 75% refund (I will keep 25% of the total cost)

  • If I feel like I can not finish the commission, I will provide a partial refund depending on how much has been completed (I will keep 15% of the total cost)

Process

  • I try to finish the commission within 1 month of receiving the payment. The commission may take up to 3 months once I start

  • There are no deadlines. If you request a rush order, there will be a 50% fee

  • WIPs will be provided throughout the process. I will require the client's approval before continuing

  • Stages:

  • Base Sketch (Composition)

  • Detailed Sketch

  • Lineart

  • Flat color

  • Shading

  • Background (if applicable)

  • Additional WIPs may be provided if I need any clarification

  • Clients may request WiPs at anytime. However, they may not freely request revisions for these WiPs

  • Clients are allowed a maximum of 3 free revisions. Any more than 3 will have a $5 fee

  • If I make a mistake, I will correct my mistake free of charge

  • Upon completion of the commission, you will receive:

  • The original size .png file

  • Half-sized version .png file, watermark included

Notes

  • The prices listed are the base prices. They may increase due to the complexity of the commissioned piece.

  • I may charge extra for things I'm not proficient or experienced in drawing

  • Additional characters cost an additional 50% of the price of the commission

  • Any details I deem complex will be charged extra

  • I will let you know if I find that the request has complex details and will quote you in advance

Personal and Commercial Use

  • All of my pieces are for personal/ non-commercial use only. Do not sell my art for monetary gain.

  • If you would like to commission art for commercial use, let me know and we can discuss it.

  • Commercial use rates will depend on several factors: the timeline of the project, the time to complete the artwork, and how the artwork would be used or distributed.

  • For commercial use, the .png file will be given with watermark removed.

  • Commercial Use: CD cover, merchandise, post card, anything that you can sell to make money

  • Personal Use: Phone wallpaper, YouTube Thumbnail, printing for yourself, anything that is just for you

Character Design TOS

When you get a custom character design from me, you can:

  • Trade them

  • Give them away as gifts

  • Name them, gender them, draw them, use them in stories, etc

  • Resell them, but no more than what you bought it for, unless you have a very good reason, like having a lot of art for said character or media pertaining to them. Buying a character for $30, and reselling them for $100 is NOT OKAY
